He told Lee that he simply just wanted his army to lay down their arms and not to take them back up for the rest of the war, unless dutly and properly exchanged. He would not take any prisoners, but he just requested that Lees narmy lay down their arms until called upon because even the the principal confederate army had vanished the war was still not over. The surrender at the Appomattox deserves an award for how well each side took it. Ulysses S. Grant was very mature and wanted no harm or arguments with his opposing side, he even allowed the officers to keep their sidearms and horses. Va. on the following terms; to wit: Rolls of all the officers and men to be made in duplicate one copy to be given to an officer designated by me, the other to be retained by such officer or officers as you may designate. The officers to give their individual paroles not to take up arms against the Government of the United States until properly exchanged and each company or regimental commander sign a like parole for the men of their commands. The arms, artillery, and public property are to be parked and stacked and turned over to the officer appointed by me to receive them. This will not embrace the side arms of the officers, nor their private horses or baggage. This done officers and man will be allowed to return to their homes not to be disturbed by United States authority so long as they observe their parole and the laws in force where they may reside. But we can not give Ulysses all the credit, Robert E Lee also had a major part in this, if he listened to some of his generals about the fact that he should disperse the troops and start a guerilla warfare, which would indeed have been very difficult for the union army to stamp out. Now if this was any other person then maybe the surrender at Appomattox Courthouse might have not ended so peacefully, or for that matter might not have even occured. Before we can point fingers we must establish what went down before the surrender at the Appomattox Courthouse. After leaving Petersburg, Lees malnourished army headed west to try and find a path around Grants army. Fighting all day as if to not stop until every last man was down to the ground. There were small fights breaking out all around them, which made up side shows of the main performance. With all that was going on General Lee maintained to keep his soldiers spirits high with his calm and cheerful presence. Lee and his army had gone through hell and back, and to add on to this baggage the Union troops decided to , in the Battle of Saylers Creek, cut off and capture a third of Lees army. With all this Lee and his army marched on, they tried to slow down the Union troops by burning down a bridge, which ultimately had no effect because the union soldiers came intime to blow out the fire. You would think by now Lee would be ready for a surrender, but even after Grant sent him a letter for surrender, he just gave it off to JAmes Longstreet who said, No not yet. And with that the soldiers got back up thinking that God would be on their side only to find that once again they would fall, and thi s time Lee agreed to the surrender, because there was nothing left for him, and he knew that if they kept on fighting, all of his soldiers would just die off. The surrender at the Appomattox Courthouse can be seen as a peaceful yet stressful time. We dont realize how stressful this must have been for Lee, we only know that, oh Grant won against lee and thats about it. Grant and his army headed in the direction of the Appomattox, and stopped at many places for food and shelter until they reached their final destination. At the end of their trip Grant started feeling sick. General Grant had been suffering from a severe headache, the result of fatigue, anxiety,and loss of sleep We would think this is due to some sort of food poisoning or sickness, but no. This was merely because he was anxious to meet Lee as well as the fact that he was getting sick.. As General Grant lay at rest on the sofa, Colonel Charles A. Later then did General Grant arrive, and him and his army slowly and quietly situated themselves in the room. As the two leaders sat across from each other they both had a strong contrast. First off General Grant was almost forty-three years and Richard E. Lee was almost sixty-three years. He had a normal height of five feet and eight inches, whereas Lee was much taller with a good six feet in height. General Grants uniform could be said as that of a private soldier. Then we look over at Lee and see he has on his best outfit, and that all the men around him are wearing clean pressed uniforms of felt and silk. Colonel Marshal explained this contrast best by saying, when their headquarters wagons had been pressed so closely by our cavalry a few days before, and it was found they had to destroy all their baggage , except the clothes they carried on their backs, each one naturally, selected the newest suit he had, and sought to perpetuate the god of destruction by a sacrifice of his second best. After three days there was a formal ceremony taken place to the break up of Lees army and parole of his men which ended the war. We see this in the picture to the right, we also notice what Colonel Marshal said about how the Union didnt dress as high class as Lees army. Richard E Lee left his men with his very thoughtful words which state: After four years of arduous service, marked by unsurpassed courage and fortitude, the Army of Northern Virginia has been compelled to yield to overwhelming numbers and resources. I need not tell the brave survivors of so many hard fought battles who have remained steadfast to the last, that I have consented to this result from no distrust of them, But feeling that valor and devotion could accomplish nothing that could compensate for the loss that would have attended the continuance of the contest, I determined to avoid the useless sacrifice of those whose past services have endeared them to their countrymen. They might become financially strong and seek a comfortable living, yet the high class society and their social values do not accept such groups. In my opinion, the term bogan is actually a misnomer used for people who have passion for rock music, wear trendy clothes, footwear, have extreme patriotism, believe in honest behaviours and are not deceptive. Though, they are believed to be antisocial, indulged into bad habits of drinking and chauvinists, they should not be laughed at or called with names. A continent or a country is made up of all kinds of people from different culture and community. They might have different thoughts, perceptions and philosophies of life, yet they are the part of the society. Thus, I strongly oppose to such labelling. I propose that the terminology bogan should be avoided as I believe it is our responsibility to eliminate classicism and social discrimination. Section four, of the act of 1867, provides, that whenever any police magistrate, or justice of the peace, shall have brought before him any boy or girl, within the ages of six or sixteen years, who he has reason to believe is a vagrant, or is destitute of proper parental care, or is growing up in mendicancy, ignorance, idleness or vice, he shall cause such boy or girl to be arrested, and, together with the witnesses, taken before one of the judges of the superior or circuit court of Cook county. The judge is empowered to issue a summons, or order in writing, to the childs father, mother, guardian, or whosoever may have the care of the child, in the order named, and if there be none such, to any person, at his discretion, to appear, at a time and place mentioned, and show cause why the child should not be committed to the reform school, and upon return of due service of the summons, an investigation shall be had. HN2The section then directs, if, upon such examination, such judge shall be of opinion that said boy or girl is a proper subject for commitment to the reform school, and that his or her moral welfare, and the good of society, require that he or she should be sent to said school for employment, instruction and reformation, he shall so decide, and direct the clerk of the court of which he is judge, to make out a warrant of commitment to said reform school; and such child shall thereupon be committed. Section nine, of the act of 1863, directs, that all persons between six and sixteen years of age, convicted of crime punishable by fine or imprisonment, who, in the opinion of the court, would be proper subjects for commitment, shall be committed to said school. Section ten authorizes the confinement of the children, and that they shall be kept, disciplined, instructed, employed and governed, until they shall be reformed and discharged, or shall have arrived at the age of twenty-one years; and that the sole authority to discharge shall be in the board of guardians. The warrant of commitment does not indicate that the arrest was made for a criminal offense. Hence, we conclude that it was issued under the general grant of power, to arrest and confine for misfortune. The contingencies enumerated, upon the happening of either of which the power may be exercised, are vagrancy, destitution of proper parental care, mendicancy, ignorance, idleness or vice. Upon proof of any one, the child is deprived of home, and parents, and friends, and confined for more than half of an ordinary life. It is claimed, that the law is administered for the moral welfare and intellectual improvement of the minor, and the good of society. From the record before us, we know nothing of the management. We are only informed that a father desires the custody of his child; and that he is restrained of his liberty. Therefore, we can only look at the language of the law, and the power granted. What is proper parental care? The best and kindest parents would differ, in the attempt to solve the question. No two scarcely agree; and when we consider the watchful supervision, which is so unremitting over the domestic affairs of others, the conclusion is forced upon us, that there is not a child in the land who could not be proved, by two or more witnesses, to be in this sad condition. Ignorance, idleness, vice, are relative terms. Ignorance is always preferable to error, but, at most, is only venial. It may be general or it may be limited. Though it is sometimes said, that idleness is the parent of vice, yet the former may exist without the latter. It is strictly an abstinence from labor or employment. If the child perform all its duties to parents and to society, the State has no right to compel it to labor. Vice is a very comprehensive term. Acts, wholly innocent in the estimation of many good men, would, according to the code of ethics of others, show fearful depravity. What is the standard to be? What extent of enlightenment, what amount of industry, what degree of virtue, will save from the threatened imprisonment? In our solicitude to form youth for the duties of civil life, we should not forget the rights which inhere both in parents and children. The principle of the absorption of the child in, and its complete subjection to the despotism of, the State, is wholly inadmissible in the modern civilized world. The parent has the right to the care, custody and assistance of his child. The duty to maintain and protect it, is a principle of natural law. He may even justify an assault and battery, in the defense of his children, and  uphold them in their law suits. Thus the law recognizes the power of parental affection, and excuses acts which, in the absence of such a relation, would be punished. Another branch of parental duty, strongly inculcated by writers on natural law, is the education of children. To aid in the performance of these duties, and enforce obedience, parents have authority over them. The municipal law should not disturb this relation, except for the strongest reasons. The case with which it may be disrupted under the laws in question; the slight evidence required, and the informal mode of procedure, make them conflict with the natural right of the parent. Before any abridgment of the right, gross misconduct or almost total unfitness on the part of the parent, should be clearly proved. This power is an emanation from God, and every attempt to infringe upon it, except from dire necessity, should be resisted in all well governed States. In this country, the hope of the child, in respect to its education and future advancement, is mainly dependent upon the father; for this he struggles and toils through life; the desire of its accomplishment operating as one of the most powerful incentives to industry and thrift. The violent abruption of this relation would not only tend to wither these motives to action, but necessarily, in time, alienate the fathers natural affections. But even the power of the parent must be exercised with moderation. He may use correction and restraint, but in a reasonable manner. He has the right to enforce only such discipline, as may be necessary to the discharge of his sacred trust; only moderate correction and temporary confinement. We are not governed by the twelve tables, which formed the Roman law. The fourth table gave fathers the power of life and death, and of sale, over their children. In this age and country, such provisions would be atrocious. If a father confined or imprisoned his child for one year, the majesty of the law would frown upon the unnatural act, and every tender mother and kind father would rise up in arms against such monstrous inhumanity. * Can the State, as parens patriae, exceed the power of the natural parent, except in punishing crime? End Footnotes- These laws provide for the safe keeping of the child; they direct his commitment, and only a ticket of leave, or the uncontrolled discretion of a board of guardians, will permit the imprisoned boy to breathe the pure air of heaven outside his prison walls, and to feel the instincts of manhood by contact with the busy world. The mittimus terms him a proper subject for commitment; directs the superintendent to take his body, and the sheriff endorses upon it, executed by delivering the body of the within named prisoner. The confinement may be from one to fifteen years, according to the age of the child. Executive clemency can not open the prison doors, for no offense has been committed. The writ of habeas corpus, a writ for the security of liberty, can afford no relief, for the sovereign power of the State, as parens patriae, has determined the imprisonment beyond recall. Such a restraint upon natural liberty is tyranny and oppression. If, without crime, without the conviction of any offense, the children of the State are to be thus confined for the good of society, then society had better be reduced to its original elements, and free government acknowledged a failure. In cases of writs of habeas corpus to bring up infants, there are other rights beside the rights of the father. If improperly or illegally restrained, it is our duty, ex debito justitiae, to liberate. The welfare and rights of the child are also to be considered. The disability of minors does not make slaves or criminals of them. They are entitled to legal rights, and are under legal liabilities. An implied contract for necessaries is binding on them. The only act which they are under a legal incapacity to perform, is the appointment of an attorney. All their other acts are merely voidable or confirmable. They are liable for torts, and punishable for crime. Lord Kenyon said, If an infant commit an assault, or utter slander, God forbid that he should not be answerable for it, in a court of justice. Every child over ten years of age may be found guilty of crime. For robbery, burglary or arson, any minor may be sent to the penitentiary. Minors are  bound to pay taxes for the support of the government, and constitute a part of the militia, and are compelled to endure the hardship and privation of a soldiers life, in defense of the constitution and the laws; and yet it is assumed, that to them, liberty is a mere chimera. It is something of which they may have dreamed, but have never enjoyed the fruition. Can we hold children responsible for crime; liable for their torts; impose onerous burdens upon them, and yet deprive them of the enjoyment of liberty, without charge or conviction of crime? The bill of rights declares, that all men are, by nature, free and independent, and have certain inherent and inalienable rightsamong these are life, liberty, and the pursuit of happiness. This language is not restrictive; it is broad and comprehensive, and declares a grand truth, that all men, all people, everywhere, have the inherent and inalienable right to liberty. Shall we say to the children of the State, you shall not enjoy this righta right independent of all human laws and regulations? It is declared in the constitution; is higher than constitution and law, and should be held forever sacred. Even criminals can not be convicted and imprisoned without due process of lawwithout a regular trial, according to the course of the common law. Why should minors be imprisoned for misfortune? Destitution of proper parental care, ignorance, idleness and vice, are misfortunes, not crimes. In all criminal prosecutions against minors, for grave and heinous offenses, they have the right to demand the nature and cause of the accusation, and a speedy public trial by an impartial jury. All this must precede the final commitment to prison. Why should children, only guilty of misfortune, be deprived of liberty without due process of law? It can not be said, that in this case, there is no imprisonment. This boy is deprived of a fathers care; bereft of home influences; has no freedom of action; is committed for an uncertain time; is branded as a prisoner; made subject to the will of others, and thus feels that he is a slave. Nothing could more contribute to paralyze the youthful energies, crush all noble aspirations, and unfit him for the duties of manhood. Other means of a milder character; other influences of a more kindly nature; other laws less  in restraint of liberty, would better accomplish the reformation of the depraved, and infringe less upon inalienable rights. It is a grave responsibility to pronounce upon the acts of the legislative department. It is, however, the solemn duty of the courts to adjudge the law, and guard, when assailed, the liberty of the citizen. The constitution is the highest law; it commands and protects all. Its declaration of rights is an express limitation of legislative power, and as the laws under which the detention is had, are in conflict with its provisions, we must so declare. It is therefore ordered, that Daniel OConnell be discharged from custody. Discharged.

However, this overall description hides the true complexity and variety of the forms that interpersonal communication can take.Indeed, to this aspect of our social life we can attribute such fundamental elements of out interaction with people as ability to initiate and maintain conversations or arguments, to listen, to spea k privately and publicly, to generate and interpret patterns of nonverbal communication, manifest our unconscious modes of communication, and any other skills that actually enable us to be active members of society. At this point, considering the proximity of the phenomenon of interpersonal communication to our everyday life, we may wonder what are the proper ways of study of forms of interpersonal communication?Of course, psychology as a strict science has its own standards and methods of investigation. But at the same time I think that we can find a lot of examples of interpersonal communication happening on a regular basis right before our eyes. To see this we may turn to the film â€Å"Dinner With Friends† (2001) directed by Norman Jewison, which provides a lot of interesting aspects relevant to the theory of interpersonal communication. Let us take a closer look and discuss such aspects.The film â€Å"Dinner With Friends† tells a story of two married couples †“ Gabe and Karen, and Beth and Tom – that have been close friends for 12 years, and were spending their time over dinners discussing their relationships, their children, and other matters and interests that friends can share. However, when unexpectedly for Gabe and Karen Beth declares that she and Tom had decided to separate, this event inflicts a profound change in the pattern of their relationships.As both couples undergo emotional turmoils it turns out that, ironically, their mutual love of cooking may be the only thing that remains between them, while their former friendship is gone. â€Å"Dinner with Friends† is mostly built upon conversations as the vehicle to unfold the story. Dyadic communication occurs in privacy between Gabe and Karen, and Beth and Tom, and also between Karen and Beth, and Tom and Gabe, when due to the break-up of their traditional relations tensions develop between these women and men.In this regard, it is interesting to point out that as Gabe and Karen perceived their friendship with Beth and Tom as a close on e, after learning about the alleged betrayal of Beth by Tom Karen is angry that she had been unaware of the brewing troubles in their marriage. Thus, the previous apparent intimacy of relations between the couples was not completely true, and it could hardly be such. As Karen bitterly says, one can spend the whole life with another person, and in the end it may turn out that the person you fully entrusted your fate to is an impostor.To this, Gabe thoughtfully responds: â€Å"But it can`t be as simple as that†. Indeed, in accordance with the developmental view of interpersonal communication, with time communicators get to know more details about each another, develop ability to partly predict their behavior, and create their own rules of communication. This fact hints about another quality of interpersonal communication, which lies in its effect on formation of our self-concepts through confirmation and gradual transformation of our identities. In application to the characters from the film, this can be evidenced by the belief of Gabe and Karen that they knew their friends very well, while in reality this was not the case.And when tensions between couples develop, Beth reevaluates the nature of gifts that Karen, who considered Beth to be â€Å"a mess†, had presented to her. In the scene where Beth declares that she has a new lover and Karen advises her to slow down, Beth observes: â€Å". . . you love it when I'm a mess. Judging from this viewpoint, small group communication between the couples can be interpreted as a dynamical process of receiving inputs, processing the information, and outputting certain behavioral modes.Input factors are present even before a group forms, and in our case it is the mutual background of the two couples, as Beth and Tom were in the first place introduced to each other by Gabe and Karen; process factors are developments that emerge in the process of communication within group, as exemplified in the film by rapid change of the format of individual relations between the personages themselves, and, consequently, between the couples in the aftermath of the break-up between Beth and Tom; finally, output factors are end results of the communication, and for Gabe, Karen, Beth, and Tom the end results were different, but in all cases prominent.For Beth and Tom the divorce meant the transformation of their lives, and for Gabe and Karen the separation of their friends from their small group serves as an impetus to come to conscious conclusion that â€Å"practical matters outweigh abandon† when it comes to their own family chores.
